At OrphoMed, Inc. (“OrphoMed”, “we” or “us”), we are committed to ensuring the privacy of our users. This privacy policy (this “Privacy Policy”) explains OrphoMed’s privacy practices related to OrphoMed’s web site, currently located at www.orphomed.com, and other online services owned or controlled by OrphoMed (collectively, the "OrphoMed Online Services").

Acceptance of Terms

The OrphoMed Online Services can only be accessed and used subject to the OrphoMed Terms of Use and this Privacy Policy. PLEASE READ THIS PRIVACY POLICY CAREFULLY.  BY USING THE SERVICE, YOU ACCEPT ALL OF THE TERMS AND CONDITIONS OF THE ORPHOMED PRIVACY POLICY AND THE ORPHOMED TERMS OF USE AND REPRESENT TO US THAT YOU ARE 18 YEARS OF AGE OR OLDER AND ARE LEGALLY COMPETENT TO ENTER INTO AND AGREE TO THE TERMS AND CONDITIONS OF THE PRIVACY POLICY AND TERMS OF USE. IF YOU DO NOT ACCEPT THE PRIVACY POLICY AND THE TERMS OF USE, THEN YOU ARE NOT AUTHORIZED TO ACCESS OR USE ANY OF THE ORPHOMED ONLINE SERVICES.

What is Personal Information?

Personal information is information that specifically identifies an individual, such as an address, telephone number, e-mail address, and information about that individual’s activities when directly linked to that person. Personal information also includes demographic information such as date of birth, gender, geographic area and preferences when such information is linked to other personal information that identifies you.

Personal Information We Collect

You may provide personal information to us in when you interact with and provided information to OrphoMed. For example, depending on the specific OrphoMed Online Services, you may provide us with personal information when you: 

  1. Contact us by email for any reason (such as to ask a question or provide us with your comments/feedback) and we collect your name and email address from this contact;
  2. Submit your resume or other personal information in response to a job opening posted on the OrphoMed Online Services.

Your use of the OrphoMed Online Services and submission of information indicates your consent to the uses of personal information described below. This information is stored on OrphoMed’s servers.

Cookies

When you visit the OrphoMed Online Services, some information is also automatically collected, such as your computer's Internet Protocol (IP) address, your computer's operating system, the browser type, the address of a referring web site, and the time and date of your visit and pages visited. This information is collected through the use of "cookies." Cookies are small files that are stored on your computer by a web site to give you a unique identification. We use cookies on the OrphoMed Online Services to help optimize your online experience. We treat this information as personal information if we combine it with, or link it to, any of the personally identifying information mentioned above which you have submitted to OrphoMed as described above. Otherwise, it is used in the aggregate only.

OrphoMed does not require that you accept cookies; however, some functionality on the OrphoMed Online Services may be disabled if you decline to accept cookies. You can set your browser to notify you when you receive a cookie, giving you the chance to decide whether or not to accept it.

Do Not Track

Do Not Track (DNT) is a privacy preference that users can set in some web browsers, allowing users to opt out of tracking by websites and online services. At the present time, the World Wide Web Consortium (W3C) has not yet established universal standards for recognizable DNT signals and therefore, OrphoMed and the OrphoMed Online Services do not recognize DNT.

How We Use Personal Information

We use personal information for internal purposes only. In general, we may use personal information to process your requests and provide you with high-quality services. We may also use personal information for certain business, auditing, research and analysis to operate and improve OrphoMed technologies and services. When we use your personal information, it may be processed on our servers in the United States of America and in other countries, and your information may be processed on a server that lies outside your own country.

Use of Aggregate Information

Personal information does not include “aggregate” information. Aggregate information is data we collect about a group or category of services or users from which individual identities have been removed. In other words, information about how you use a service may be collected and combined with information about how others use the same service, but no personal information will be included in the resulting data. Aggregate data helps us understand trends and customer needs so that we can better consider new services and tailor existing services to customer desires. We may share aggregated non-personal information with third parties outside of OrphoMed.

Sharing of Personal Information

We do not sell, rent or share personal information with third parties without your prior consent, except in the limited circumstances described in this Privacy Policy. We share personal information with third-party vendors and contractors who assist us in performing internal functions necessary to operate our business. These functions may include, for example, analyzing data and providing support for the OrphoMed Online Services. We require our third party vendors to only use the information for the purpose it was provided. We are not responsible for any additional information you provide directly to third parties, and we encourage you to become familiar with their practices before disclosing information directly to them.

We also reserve the right to disclose personal information when we believe it is required or appropriate to comply with the law or legal process (e.g., a lawful subpoena, warrant or court order); to enforce or apply this Privacy Policy or our other policies or agreements; to protect our or our users' rights, property or safety; to prevent or protect our users from fraudulent, abusive, or unlawful use of the OrphoMed Online Services; to ensure the security of our network and services; or if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of records without delay.

In addition, information about our users, including personal information, may be disclosed as part of any merger, acquisition, debt financing, sale of company assets, as well as in the event of an insolvency, bankruptcy or receivership in which personal information could be transferred to third parties as one of the business assets of the company, and any such acquirer or transferee will have the right to use and disclose such information subject to the terms of this Privacy Policy.

Prior to sharing personal information of our users with others, agreements are made between OrphoMed and such outside parties to whom we are transferring data to provide for the allowable use and security of the transferred information in accordance with this Privacy Policy and applicable law. If OrphoMed becomes aware that any such outside party is improperly using or disclosing personal information, it will notify that outside party and request that it take reasonable steps to cease such use or disclosure.

Links to Other Web Sites

The OrphoMed Online Services may contain links to other web sites. Any personal information you provide on the linked pages is provided directly to that third party and is subject to that third party’s privacy policy. Except as described above, we are not responsible for the content or privacy and security practices and policies of web sites to which we link. Links from the OrphoMed Online Services to third parties or to other web sites are provided for your convenience only. OrphoMed’s inclusion of such links does not imply any endorsement of the content on such web sites or of their owners or operators except as disclosed on the OrphoMed Online Services. We encourage you to learn about their privacy and security practices and policies before providing them with personal information.

Use of the OrphoMed Online Services by Children

You must be 18 years old or older to use the OrphoMed Online Services. Accordingly, we do not knowingly collect information from children under the age of 13. If we become aware that we have inadvertently received information from a child under the age of 13, we will delete such information from our records.

Security

We have put into place reasonable security measures in an effort to protect personal information while it is under our control.

Policy Changes

From time to time, we may change this Privacy Policy. If we change this Privacy Policy, we will inform you by posting the revised Privacy Policy on the OrphoMed Online Services. Those changes will go into effect on the Revision Date shown in the revised Privacy Policy. It is your sole responsibility to check the OrphoMed Online Services from time to time to view any such changes in the Privacy Policy. By continuing to use OrphoMed Online Services, you agree to the revised Privacy Policy.

Governing Law

This Privacy Policy shall be subject to the “Governing Law and Arbitration; No Class Action” provision in the OrphoMed Terms of Use.
